Generally a Trust or Will that complies with statutory requirements is valid unless it is established that the person signing was of unsound mind, or subject to undue influence.The Firm handles matters dealing with enforcing the rights of interested parties under Trust Agreements, Wills, and intestate succession. This includes representing Trustees, designated beneficiaries, intestate heirs, personal representatives and creditors of probate proceedings.

Negligence Defined:
Negligence is the doing of something which a reasonably prudent person would not do, or the failure to do something, which a reasonably prudent person would do, under similar circumstances.
BAJI 3.10.

Evidence as to whether a person conformed or did not conform to a custom or practice in a given locality or business may be considered. BAJI 3.16.

A person who is exercising ordinary care has a right to assume that other persons are ordinarily intelligent, and possessed of normal sight and hearing and are obeying the law. BAJI 3.13, 3.14.
